Terms and Conditions



Intuit provides assisted callback support for QuickBooks 2006: Pro and Premier Edition for Windows and Macintosh at no additional charge for 30 days from the date you register the software. By using the support, you are agreeing to the following support terms and conditions. Terms, conditions, pricing, features and service options for support are subject to change at any time without notice.

General Policies
Customer means the person who registers the QuickBooks 2006: Pro or Premier Edition software for Windows or Macintosh ("QuickBooks"). During the term of the included support period, a Customer will receive callback support for an unlimited number of incidents. Intuit reserves the right to limit each contact to one hour and to limit each contact to one incident, as defined below.

For purposes of these terms and conditions an "incident" means a single: (a) issue or problem a Customer asks a support representative to analyze or resolve, (b) software-usage question that involves a single topic on a dropdown menu, or (c) question on a specific QuickBooks software topic. The technical support representative will determine how many incidents will be handled during the course of a contact.

Support Limitations
The offer of 30-day software support coverage is valid within 90 days after purchase of QuickBooks. Support is limited to 30 days from the date of first-time registration of the software. Intuit will not delay activation of support coverage for registered software. Service availability may occasionally deviate from the stated hours due to downtime for system and server maintenance, company events, observed U.S. holidays, and events beyond our control. Support is limited to the following QuickBooks software product areas: installation, upgrade assistance and basic functionality as described in the QuickBooks documentation. Support for personal computers is not included in the QuickBooks support services and questions about your hardware should be directed to the hardware supplier. Intuit may also limit or terminate support to a customer who uses the support service in an unreasonable, excessive, abusive or fraudulent manner. This support entitlement is non-transferable. The resale or other transfer of any support rights is strictly prohibited, and will be considered an abuse of the support services. No refunds will be provided to customers who do not use the 30 days of support. Callback support requires internet access and is only available in the United States. Intuit is not responsible for long-distance telephone charges incurred in connection with the use of support from a location outside the United States.

Outbound Callback Response Time Goals
Our goal is that a technical support representative will respond to a Customer within then-current published response goals, subject to variations due to downtime for systems and server maintenance, company events, observed U.S. holidays, and events beyond our control. Response goals may not be deemed a representation or warranty on Intuit's behalf regarding the time within which a resolution, if any, may be available for any particular incident. Intuit's published response time goals are not guarantees. No remedy is available for Intuit's failure to meet the published response time goal.

Limitation of Liability and Damages
IN NO EVENT SHALL INTUIT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGE, AND ON ANY THEORY OF LIABILITY, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE SUPPORT SERVICES AND INFORMATION PROVIDED. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

Disclaimer of Warranties
SUPPORT SERVICES ARE PROVIDED "AS IS." INTUIT HEREBY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS AND IMPLIED, REGARDING THE SUPPORT SERVICES OR ANY RELATED MATERIALS, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, QUALITY, MERCHANTABILITY, ACCURACY AND NON-INFRINGEMENT. Some states do not allow the exclusion of implied warranties, so the above exclusions may not apply to you. In that event, any implied warranties are limited in duration to thirty (30) days from the first date of support service. However, some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

Governing Law
These terms will be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of laws. Customer agrees that any action arising out of or relating to the support service provided by Intuit will be filed and maintained only in the state or federal courts located in San Francisco, California, and Customer hereby consents and submits to the personal jurisdiction of such courts for the purpose of litigating any such action. If any provision of these terms is deemed unlawful, void or unenforceable for any reason, then that provision will be deemed severable from these terms and will not affect the validity and enforceability of any remaining provisions. This is the entire agreement between Intuit and the Customer relating to the subject matter of these terms, and may not be modified except in a writing signed by both the Customer and an authorized representative of Intuit.

Privacy Statement
Your use of the support service is subject to Intuit's Privacy Statement, as may be amended from time to time, as set forth at http://quickbooks.intuit.com/commerce/catalog/fragments/quickbooks/2006/common/privacy.jhtml. By registering QuickBooks software, you consent to the use of your personally identifiable information in accordance with such privacy statement.
